This is a supplemental complaint because Capital Ones response to my original CFPB filing did not address the core issues I raised. Their response only stated that they can not cancel the claim and that they have 90 days to investigate, but they did not address the following : - The missing provisional credit, required under the Fair Credit Billing Act ( FCBA ) - The fact that the merchant was debited but I was not credited.
- The fact that I am experiencing property harm because my vehicle is being held under a mechanics lien.
- The fact that Capital One mischaracterized my complaint as only a request to cancel a claim, ignoring the FCBA violations and financial harm Capital Ones response is incomplete, nonresponsive, and does not resolve the issue.
Since filing the original complaint, I have since discovered : -Neither I nor the merchant received a dispute acknowledgment, an investigation notice, or a merchant chargeback notice. The complaint response states they are pending the merchant response ; however, the merchant has not received the dispute notice or any communication to actually respond.
