False statements or representation: Debt collection
Lvnv funding brought an old debt. They didn't validate the debt to show me the original creditor the amount owed and proof that LVNV legally owns the debt.

I have protested several times that the debt is fraud as the amount listed and the address listed as well as several factors do not match the information on file. This is an erroneous attempt of balance billing and this is not owed on my behalf.

I am stressed out because this company is violating my rights Under 15 U.S.C. 1681s-2 ( a ), data furnishers are required to report only accurate and complete information. Reporting unverifiable or inaccurate data is a violation of federal law, and that is what this company is doing.

Help my rights continue being violated, 15 U.S.C. 1692g ( b ) of the FDCPA requires debt collectors to cease collection activities and provide proper validation of the debt when requested in writing within 30 days of initial contact. The accounts Ive referenced are not 100 % accurate. Until you provide competent evidence that validates the debt including a signed agreement, full account history, and verification of your authority to collect you must cease all collection efforts and remove the information from my credit report.

I previously submitted a written request for debt validation regarding the alleged account. However, the response I received was incomplete and failed to provide the documentation necessary to substantiate the alleged debt or the collector 's legal authority to collect it. To date, I have not received sufficient documentation demonstrating the validity of the alleged debt, the ownership of the account, or the basis for the amount claimed.

I submitted a written debt validation request to LVNV Funding LLC and Resurgent Capital Services requesting specific documentation concerning their collection of this account. The company responded ; however, its response consisted primarily of an internally prepared account summary, administrative correspondence, and a historical billing statement. The response did not specifically address several documentary requests contained in my validation letter. My concern is not that the company failed to respond. My concern is that it did not provide a document-specific response to the requests I made or explain whether the requested records exist or are unavailable. I respectfully request that the CFPB require LVNV Funding LLC and Resurgent Capital Services to provide a complete response addressing each outstanding documentary request individually or clearly state, in writing, if any requested document does not exist or is not within their possession, custody, or control. If they are unable to substantiate their collection activity or the information they have furnished with competent documentary evidence, I request that they take the appropriate corrective action regarding their collection efforts and any information furnished concerning this account.
