Dealing with your lender or servicer: Student loan
I am requesting the Consumer Financial Protection Bureau to investigate MOHELA for multiple violations related to the origination and servicing of my federal student loans. I did not receive required federal disclosures, including entrance counseling, interest rate disclosures, repayment information, or borrower rights and responsibilities. I did not speak with any representative from MOHELA or my school before the loans were originated. I did not understand the terms of the loans, and no one explained them to me. I am concerned that the loans were originated without proper informed consent and without the disclosures required under federal law. I am also concerned that MOHELA can not produce valid documentation, including : Original Master Promissory Notes Electronic signature logs IP address and timestamp records Disclosure delivery records Entrance counseling documentation Origination records Servicing notes I have requested a full account audit from MOHELA, but I am filing this complaint because I believe my rights as a borrower have been violated and I need federal oversight to ensure MOHELA complies with the law. I am asking the CFPB to require MOHELA to : Produce all required loan origination and disclosure documents Provide proof of my electronic signature and consent Provide proof that disclosures were delivered and acknowledged Correct any errors or omissions Investigate whether the loans were improperly originated Address any servicing misconduct I am also requesting that the CFPB review whether MOHELAs actions constitute unfair, deceptive, or abusive acts or practices ( UDAAP ).
