Complaint : Failure to Provide Proof of Permissible Purpose Under the Fair Credit Reporting Act I am submitting this complaint because a company accessed my consumer credit report and has repeatedly failed to provide competent documentary evidence demonstrating that it had a legally permissible purpose under the Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681b. After reviewing my credit reports, I discovered that the company placed an inquiry on my file. I do not recognize any credit application, contractual relationship, or transaction that would have authorized this access. I have sent multiple written requests demanding that the company identify the specific permissible purpose relied upon and provide supporting documentation, including any signed application, authorization, contract, or other records demonstrating that it had the legal right to obtain my consumer report. Despite the passage of significant time and multiple opportunities to respond, the company has failed to provide any competent documentary evidence supporting its inquiry. Instead of addressing my requests with documentation, the company has either failed to respond or has provided incomplete and unsupported explanations that do not establish compliance with the Fair Credit Reporting Act. Under 15 U.S.C. 1681b, a consumer report may only be obtained for a permissible purpose specifically authorized by law. If a company can not demonstrate that such a purpose existed at the time it obtained my report, the inquiry should not remain on my consumer reports. I respectfully request that the CFPB investigate this matter and require the company to : Produce competent documentary evidence establishing the exact permissible purpose relied upon under 15 U.S.C. 1681b. Provide copies of any signed authorization, application, agreement, or other documentation authorizing the inquiry. Explain the factual basis for obtaining my consumer report. If the company can not establish a lawful permissible purpose, immediately request the permanent deletion of the inquiry from all consumer reporting agencies. I believe I have acted in good faith by attempting to resolve this matter directly before seeking regulatory assistance. Because the company has failed to adequately respond after multiple written requests, I am asking the CFPB to assist in ensuring compliance with the Fair Credit Reporting Act and protecting my consumer rights.
