Incorrect information on your report: Credit reporting or other personal consumer reports
In accordance with the Mandate for the Credit Bureaus under 15 U.S.C. 1681 and the Duties of Furnishers under 15 U.S.C. 1681s-2 ( b ), this serves as my eighth ( 8th ) and final formal notice of a catastrophic breakdown in accuracy procedures. I. STATEMENT OF SYSTEMIC FAILURE Despite seven ( 7 ) consecutive rounds of specific, fact-based disputes, the Credit Reporting Agency ( CRA ) has failed to perform a reasonable investigation or maintain reasonable procedures under 15 U.S.C. 1681e ( b ). The CRA continues to report unverified, inaccurate, and inconsistent data, specifically regarding " Past Due '' payment histories that should legally be updated to " Paid on Time. '' II. ENUMERATED STATUTORY VIOLATIONS Violation of 15 U.S.C. 1681i ( a ) ( 5 ) ( A ) : After seven rounds, the disputed items remain unverified. The law states the agency " shall '' promptly delete or modify information that " can not be verified. '' By failing to act, the CRA is in direct violation of a non-discretionary federal mandate. Violation of 15 U.S.C. 1681s-2 ( b ) : The furnisher has failed to provide a complete and accurate payment ledger. Under this statute, the failure of a furnisher to verify a debt requires the CRA to permanently suppress the data. Violation of 15 U.S.C. 1681n & 1681o : This persistence in reporting invalidated data constitutes Willful and Negligent Non-Compliance. The CRA is now liable for actual damages, including the severe emotional distress and financial exclusion I have suffered. Breach of 12 U.S.C. 5511 : I am invoking the CFPB 's mandatory duty to protect consumers from unfair, deceptive, or abusive acts or practices ( UDAAP ) perpetrated by CRAs that refuse to follow the FCRA. XXXXII. FINAL DEMAND FOR CORRECTIVE ACTION I demand the CFPB exercise its plenary authority under 15 U.S.C. 1681s to compel the concerned Credit Bureau to : 1.Modify and Update : Immediately update the Inaccurate Past Dues in the payment history to " Paid on Time / Never Late. 2.Mandatory Deletion : If the CRA can not produce correct evidences respond to the complaint, must be permanently deleted per U.S.C. 1681i ( 5 ) for this following Items Listed Below
