Struggling to pay mortgage: Mortgage
I respectfully request that the Consumer Financial Protection Bureau investigate U.S. Bank National Association 's mortgage servicing practices, escrow administration, and the accuracy of representations made concerning my mortgage loan. I am currently involved in pending litigation concerning this mortgage loan. During my investigation, I have identified significant questions regarding U.S. Bank 's servicing records, escrow administration, communications with third parties, and the factual basis for representations made concerning my loan. My homeowner 's insurance company has represented through billing statements and its online customer portal that my homeowner 's insurance premiums are paid through an escrow account by my mortgage company and has identified U.S. Bank in connection with my homeowner 's insurance policy. However, I have personally made homeowner 's insurance premium payments, and I have repeatedly questioned the accuracy of those representations. I have submitted written requests to my insurance company seeking documentation identifying when U.S. Bank was associated with my policy, who requested that association, and what records support those representations. Because U.S. Bank is the mortgage servicer communicating information to third parties concerning my loan, I am requesting that CFPB require U.S. Bank to explain the factual basis for those communications and produce the business records supporting them. This complaint is not a request for CFPB to resolve the legal issues pending before the court. Rather, I request that CFPB require transparency regarding U.S. Bank 's servicing records, escrow records, and communications so that I may determine whether the information maintained concerning my mortgage loan is complete and accurate. Given the pending litigation, complete disclosure of the servicing records is important to ensure the accuracy of information maintained about my loan and to resolve inconsistencies regarding escrow administration and mortgage-related communications. Requested Response Please require U.S. Bank to answer each of the following in writing and identify the business records supporting each answer. State the legal and factual basis upon which U.S. Bank currently services my mortgage loan. Identify every agreement, transfer record, servicing record, boarding record, or other business record upon which U.S. Bank relies in servicing my loan. State the date U.S. Bank first began servicing my loan and identify the records supporting that date. Produce the complete servicing transfer history identifying each transferor, transferee, transfer date, and the business records documenting each transfer. State whether U.S. Bank has ever maintained an escrow account for homeowner 's insurance relating to my loan. If an escrow account existed, identify : when it was established ; every deposit ; every disbursement ; every insurance premium allegedly paid ; and the present status of the account. Produce the complete escrow accounting from the date U.S. Bank began servicing my loan through the present. Identify every homeowner 's insurance premium allegedly paid by U.S. Bank, including : payment date ; amount ; recipient ; payment method ; and supporting accounting records. Identify every communication between U.S. Bank and my homeowner 's insurance carrier regarding : homeowner 's insurance ; escrow ; mortgagee designation ; loss payee designation ; premium billing ; policy changes ; insurance claims. Produce every document transmitted by U.S. Bank to my homeowner 's insurance carrier identifying U.S. Bank as mortgagee, servicer, escrow administrator, or additional interest. Identify every document relied upon before representing to third parties that U.S. Bank was entitled to administer homeowner 's insurance matters relating to my loan. Identify every database, servicing platform, vendor, investor system, or third-party source from which U.S. Bank obtained information concerning my loan. State whether U.S. Bank has reviewed the accuracy of the information communicated to my homeowner 's insurance carrier after receiving notice that I dispute the servicing records. Identify every correction, if any, made after receiving notice of my dispute. State whether U.S. Bank possesses any additional servicing records, escrow records, communications, or documents concerning my loan that have not previously been disclosed to me. If any requested records do not exist, state that fact expressly and identify the reason those records are unavailable. Preserve all paper records, electronic records, emails, servicing notes, call recordings, audit logs, payment histories, escrow records, imaging systems, correspondence, and electronically stored information relating to my loan while this complaint and the related litigation remain pending.
