Struggling to pay mortgage: Mortgage
Company : Freedom Mortgage Corporation Issue : Mortgage Servicing Loss Mitigation / Forbearance / Loan Modification Handling ( VA Loan ) Complaint Narrative : We are filing this complaint regarding the handling of our mortgage account and loss mitigation process on a VA-backed loan. We fell behind on our mortgage approximately one year ago. At the outset, we were informed that we may qualify for a loan modification. However, after entering the loss mitigation process, our account was instead placed into a continuous cycle of forbearance periods and repeated reapplications for loss mitigation review. We have not signed any written forbearance agreement. All discussions regarding forbearance occurred verbally by phone, and no executed agreement has been provided. Each time a forbearance period ends, the account is not moved toward a final modification decision. Instead, we are placed back into a new loss mitigation review cycle. This has resulted in an ongoing loop without resolution or a permanent repayment option being offered or finalized. We were also informed that a title issue is preventing approval of a permanent modification. The servicer referenced a judgment lien ; however, this lien does not belong to us. It appears to be an identity error involving another individual with the same first and last name. Documentation was provided to the servicer showing this discrepancy, but the issue continues to be cited without supporting explanation or documentation. We have not been provided with sufficient information regarding the basis for denial, the alleged title defect, or the reason a permanent loss mitigation option can not be completed. As a result, we remain in an unresolved servicing cycle without a final determination or clear path forward.
