Written notification about debt: Debt collection
I am filing this complaint regarding the collection activities and credit reporting conducted by Credit Collection Services concerning an alleged account. My concern is not simply whether a debt exists. Rather, my concern is whether Credit Collection Services has the legal authority to collect this account and furnish information concerning it to consumer reporting agencies. Despite reporting this alleged account and attempting to collect it, Credit Collection Services has not demonstrated its legal standing or authority to do so. Accordingly, I request that Credit Collection Services provide documentation establishing the basis for its collection and reporting activities, including : * The complete chain of title identifying every entity that has owned this alleged account. * The complete chain of assignments reflecting every transfer of rights from the original creditor to the current owner. * Any purchase and sale agreement, bill of sale, assignment agreement, or similar documents demonstrating that this specific account was transferred or included in a portfolio sale. * Any forbearance agreement, servicing agreement, collection agreement, or other contract upon which Credit Collection Services relies to claim authority to collect this account, if applicable. * Documentation identifying the entity that authorized Credit Collection Services to furnish information regarding this account to the consumer reporting agencies. * Documentation establishing whether Credit Collection Services is the legal owner of the account or is acting solely as a third-party collection agency. * Documentation establishing its legal standing to collect this alleged obligation. In addition, I do not recall receiving the written notice required following the initial communication regarding this alleged debt. If Credit Collection Services contends that it complied with the notice requirements of the Fair Debt Collection Practices Act, I request that it identify : * The date the notice was mailed ; * The address to which it was mailed ; * A copy of the notice that was allegedly sent ; and * Documentation demonstrating its mailing procedures for that notice. It is my position that a company should not be reporting an alleged debt to consumer reporting agencies or engaging in collection activity unless it can demonstrate that it has the legal authority to do so. If Credit Collection Services can not produce documentation establishing its ownership, authority, standing, or authorization to report this account, I request that it immediately cease collection activity and request deletion of any information it has furnished regarding this account to the consumer reporting agencies. I respectfully request that the CFPB require Credit Collection Services to provide a complete response addressing each request individually and to produce the supporting documentation upon which it relies for its collection and reporting activities.
